 불충분한 지불

  • Since 01.04.2014, backdating of the payment is no longer possible.
    • 항상 지정된 기한 내에 모든 돈이 지불되어야 한다.
  • deposit에 조금 있는 경우
    • If there are insufficient funds in the deposit account, this fact is communicated to the holder [7.4.1 ADA].
  • 비용 인상이 있는 경우
    • EPO는 일반적으로 경과규정을 제공하며, 통상 2개월의 기한과 함께 비용 지불 invitation 을 준다.

비용 기한
  • 심사청구료
    • 심사청구가 제출될 때 due (출원부터 심사청구 가능하므로 미리 제출 가능)
    • ESR 공개 후 6개월까지 납부할 수 있음
    • PCT 단계 31개월 (E-IX, 2.1.4)
    • R70(2) invitation 에 따라 진행 여부 답변 안하면 취하간주 (R 70(3) EPC)
  • 지정료
    • ESR 공개 하면서 due (일찍 낼 수 있지만 due 이후에 고려됨)
    • ESR 공개 후 6개월까지 납부할 수 있음
    • PCT 단계 31개월 (E-IX, 2.1.4)
    • 기한 내에 납부 안하면, 취하 간주 (Rule 39(2) EPC)
  • 갱신료

Rule 51 Payment of renewal fees

(1) A renewal fee for the European patent application in respect of the coming year shall be due on the last day of the month containing the anniversary of the date of filing of the European patent application. The renewal fee in respect of the third year may not be validly paid more than six months before it falls due. All other renewal fees may not be validly paid more than three months before they fall due.

 (2) If a renewal fee is not paid on the due date under paragraph 1, the fee may still be paid within six months of the said date, provided that an additional fee is also paid within that period. The legal consequence laid down in Article 86, paragraph 1, shall ensue upon expiry of the six-month period. 
    • due date는 anniversary가 있는 달의 마지막 날 (Rule 51(1) 전단 EPC)
      • 연휴인 경우 그 다음달 초로 연장될 수 있음
      • 예외는 PCT 31개월 만료일, 절차 interruption
    • due date로부터 6개월전부터 납부할 수 있음 (Rule 51(1) 후단 EPC)
    • due date로부터 6개월 이내에 추가 요금과 함께 납부할 수 있음 (Rule 51(2) EPC)
    • EP 특허의 갱신료 - 대체로 due date 이후 6개월의 grace period 주어짐. 이 때까지 surcharge 내면서 유효하게 납부할 수 있음.
  • Due date 전에 납부한 경우
    • GL A-X, 5.1.1 Payments made before the due date which are not valid may be refunded by the EPO. If payment is made shortly before the due date, it is possible that the EPO will not return the payment. In this case, however, payment only takes effect on the due date. This does not apply to payments via deposit account of renewal fees made before the earliest valid payment dates under Rule 51(1), see A‑X, 5.2.4.
      • 환불 요청하는 것은 안됨. EPO가 자동으로 환불해 줌.

EPO는 23년 1월부터 이의신청의 구두절차(oral proceeding)의 기본 형식을 화상회의(ViCo)로 정하였음

2020년 코로나 팬데믹 이후로 유럽특허청은 이의 신청의 구두절차를 화상회의로 진행하는 파일럿 프로젝트를 시행하였습니다. 이 파일럿 프로젝트는 2022년 12월 31일까지 해보는 것으로 계획되어 있었고, 2023년부터 어떻게 진행할 것인지가 최근 발표되었습니다. 이에 앞서 유럽특허청은 파일럿 프로젝트에 대한 평가 보고서 를 공개하였습니다. 이용자 만족도 조사가 있었고, 아래와 같이 3/4 이상이 "매우 좋음" 또는 "좋음"으로 평가하였습니다.   이러한 높은 만족도에 부응하여 유럽특허청 장( António Campinos)은 2023년 1월 1일부터 진행되는 이의신청 구두절차의 디폴트 형식을 화상회의인 것으로 결정하였습니다. 발표 내용은 여기 에서 확인할 수 있습니다.

[유럽특허 독파하기] 13. 발명자의 지정 (Designation of the inventor)

조문 Article 62 Right of the inventor to be mentioned The inventor shall have the right, vis-à-vis the applicant for or proprietor of a European patent, to be mentioned as such before the European Patent Office.  A62 - 발명자는 언급될 (도덕적) 권리가 있다. Article 81 Designation of the inventor The European patent application shall designate the inventor. If the applicant is not the inventor or is not the sole inventor, the designation shall contain a statement indicating the origin of the right to the European patent. A81 - 특허 출원은 발명자를 지정해야 한다.
